Subject: Complaint
against torture and extrajudicial execution of Mr Harilal
Yadav (52), a Food Corporation of India employee at the at
the Rani ki Sarai police station, Lucknow, Uttar Pradesh on
31 March 2003.
Dear Justice Anand,
I am writing to
seek immediate intervention of the National Human Rights Commission
against illegal detention and custodial death of torture and
extrajudicial execution of Mr 35-year-old, Mr Dollchand of
Ameer Nagar in Ramkot police circle of Sitapur, Locknow of
Uttar Pradesh yesterday on 1 July 2003. Mr Dollchand is a
Dalit.
Mr Dollchand was
arrested by constables Suresh Singh and Kesri Narain Verma
on 1 July 2003 around 2 pm. He was reportedly held in connection
with a warrant issued against him from the office of the district
magistrate and was expected to appear before the court on
July 23. Police were unable to say what the warrant contained.
Mr Dollchand was
brought to the Kachnar police outpost of Ramkot police station
where the two constables reportedly locked him in a room and
went away. When they returned an hour later, they allegedly
found Dollchand's body hanging from the ceiling of the room
tied with a gamcha (cotton scarf).
I shall be grateful
if the NHRC could kindly make an urgent intervention and take
the following measures:

Direct the State government of Uttar Pradesh to order a judicial
inquiry into the extrajudicial execution of Mr Hiralal;

Direct the State government of Uttar Pradesh to provide the
most mortem report which should have been conducted in full
conformity with the guidelines provided by the National Human
Rights Commission;

Direct the State government of Uttar Pradesh to suspend the
concerned police personnel, Mr Jaiendra Kumar Singh and sub-Inspector
Mr Narandra Bahadur Singh and take necessary action;
-
Direct the State government of Uttar Pradesh to pay interim
compensation of Rs 500,000 (five lakhs) to the victim's family
and the same be recovered from the guilty police personnel;

Direct the State government of Uttar Pradesh to provide the
FCI job held by Hiralal to his son, Jitendra on compassionate
ground; and
-
Take any other measures that the NHRC deems fit.
