Subject: Complaint
against custodial death of Mr Dipak Lama, an under trial at
the Alipurduar subsidiary correctional home under Siliguri
district of West Bengal on 3 February 2003.
Dear Justice Anand,
I am writing to
seek the intervention of the National Human Rights Commission
against the custodial death of 29 years old Mr Dipak Lama,
an under trial at the Alipurduar subsidiary correctional home
under Siliguri district of West Bengal on 3 February 2003.
Mr Lama was brought to the correctional home in November 2002
for allegedly possessing arms without valid licenses.
Mr Jiban Krishna
Sadhukha, Superintendent of the correctional home said fellow
inmates informed him of the incident early in the morning
of 3 February 2003 after repeated attempts to wake him up
failed. "Lama was rushed to the Alipurduar Sub-Divisional
Hospital where he died," Sadhukha said.
However, hospital
sources reportedly stated that Mr Lama was "brought dead".
I shall be grateful
if the NHRC could kindly intervene by taking the following
measures:

Direct the State government of West Bengal to order an inquiry
into the custodial death of Mr Deepak Lama and submit it to
the NHRC;

Direct the State government of West Bengal to inquire into
the health facilities of the Alipurduar correctional home
and report to the NHRC;

Direct the State government of West Bengal to pay interim
compensation of Rs 100,000 (one lakh) to the relatives of
the victim; and
-
Take any other measures that the NHRC deems fit.
