Subject: Complaint against the torture and custodial death of Mr Animul Islam of Puran Diara village under Mancachar police station in Dhubri district of Assam on 30 August 2003.

Dear Justice Anand,

I am writing to seek immediate intervention of the National Human Rights Commission against the torture and custodial death of Mr Animul Islam of Puran Diara village under Mancachar police station in Dhubri district of Assam.

Mr Islam was allegedly beaten to death by police, who suspected him to be a dacoit. Mr Islam, hawker was picked up by police on 28 August 2003 night from Puran Diara and taken into the Mancachar police station. He was allegedly beaten up badly in the police station. He was later admitted to Kukurmara Public Health Centre, where he succumbed to his injuries.

I shall be grateful if the NHRC could kindly intervene against the custodial death of Mr Animul Islam and take the following measures:

-          Direct the State Government of Assam to suspend the officer in charge of Mancachar police station and order a judicial inquiry into the custodial death of Mr Animul Islam

-          Direct the State Government of Assam to provide the autopsy report which should have been conducted in full conformity with the NHRC guidelines on custodial deaths/rapes to the NHRC;

-          Direct the State Government of Assam to pay an interim compensation of Rs 500,000 (five lakhs) to the victim's family and the same be recovered from the guilty police personnel;

-          Direct the Government of India to ratify the United Nations Convention Against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment; and

-          Take any other measures that the NHRC deems fit.
