Subject: Complaint against illegal detention of Mukesh Kumar for 72 hours without an FIR at Hazaribagh police station of Jharkhand from 26-29 June 2003.

Dear Justice Anand,

I am writing to seek intervention against illegal detention of 25 years old, Mukesh Kumar for 72 hours without an FIR at Hazaribagh police station of Jharkhand from 26-29 June 2003.

According to Mr Mukesh Kumar, a resident of Sheopuri Mohalla, inspector S.N. Singh lived in a rented apartment at Lohsingina area, near his house. The landlord, Srikant Singh, was a family friend and Mukesh and his father used to visit his house often. During the Ramnawami ceremony this year, when the inspector and his family were out of station, his house was burgled. The inspector lodged an FIR at Sadar police station. Later he was transferred to Charhi.

A fortnight ago, inspector Singh got in touch Mr Mukesh Kumar's father and enquired about one of his relatives residing in Suresh Colony. Inspector Singh said he wanted to get his daughter married in the family. He requested Mukesh's father, Abhimanyu Singh, to accompany him to Suresh Colony.

But the family turned down the alliance between Singh's daughter and their son. The inspector visited the family several times to convince them. But the family refused to relent. Singh felt slighted and accused Mukesh and his father of conspiring against him and threatened them with dire consequences. He alleged that Mukesh had masterminded the theft in his house and his former landlord had a hand in it. He alleged that whenever he went out of station, he handed over the keys to the landlord. Singh said the landlord had handed over the keys to Mukesh, who allegedly let in the burglars.

On 26 June 2003, Mukesh was picked and taken to Sadar police station for interrogation.

I shall be grateful if you could personally intervene against such gross mis-use of power by taking following measures:

1.      Direct the State government of Jharkhand to order an inquiry into the illegal detention of Mr Mukesh Kumar and submit the report within four weeks;

2.      Direct the State government of Orissa to pay exemplary compensation of Rs 50,000 to Mr Kumar for such illegal detention and that the same be recovered from the concerned police personnel; and

3.      Take any other measures that the NHRC deems fit
