Subject: Complaint against the alleged torture of Mr Hemlun Kipgen of Haipi village, Senapati district and extrajudicial execution of Mr Seikholen Kipgen of Songtun village by the 14th Assam Rifles personnel in Sadar Hills districts of Senapati, Manipur.

Dear Justice Anand,

I am writing to seek the intervention of National Human Rights Commission against the alleged torture of Mr Hemlun Kipgen of Haipi village, Senapati district and extrajudicial execution of Mr Seikholen Kipgen of Songtun village by the 14th Assam Rifles personnel in Sadar Hills districts of Senapati, Manipur.

Torture of Mr Hemlun Kipgen

On 3 July 2003, the personnel of the 14th Assam Rifles under the command of Major Rajmir Singh conducted a search operation with trekker dogs to comb Haipi, a Kuki village in Sadar Hills of Senapati district. During the search operation, the Assam Rifles personnel subjected one Mr Hemlun Kipgen with giving any valid reasons. The Assam Rifles personnel then let the trekker dogs maul Mr Hemlun Kipgen very badly. Mr Kipgen was badly bitten by the dog. The Assam Rifles personnel did not provide any anti-rabbit care for the victim and he has been undergoing treatment at his own cost.

Extrajudicial execution of Mr Seikholen Kipgen

On 10 July 2003, another battalion of the Assam Rifles dragged out a newly married couple of Songtun village. The wife was severely beaten up and the husband, identified as Mr Seikholen Kipgen alias Sesen was killed after giving third degree treatment. Although, the Assam Rifles personnel claimed of recovering one 9 mm pistol and some ammunition from the possession of the deceased, Mr Lamkhothang Kuki, President of the All India Kuki Youths Federation on record in a memorandum submitted to Manipur Chief Minister Ibobi Singh claimed that it was an excuse to justify their unlawful method of killing innocent people.

I shall be grateful if the NHRC could kindly intervene and issue the necessary directions.

-          Direct the State government of Manipur and Ministry of Home Affairs to conduct an inquiry into the alleged torture of Mr Hemlun Kipgen of Haipi village, Senapati district and extrajudicial execution of Mr Seikholen Kipgen of Songtun village and submit a report within four weeks;

-          Direct the State government of Manipur and Ministry of Home Affairs to pay an interim compensation of Rs 50,000 to Mr Hemlun Kipgen;

-          Direct the State government of Manipur and Ministry of Home Affairs to pay an interim compensation of Rs 100,000 to the wife of Mr Seikholen Kipgen; and

-          Take any other measures that the NHRC deems fit.
