Rule of the jungle in the name of emergency, 20 July 2005
On 15 July 2005, Prime Minister Thaksin Shinawatra government imposed the "Emergency Decree on Public Administration in Emergency Situation, B.E. 2548" to replace the existing martial law. It gives the Prime Minister absolute power to declare a state of emergency without the sanction of the parliament. The provisions of the Emergency Decree violate the cardinal principles of administration of justice, due process of law and the rule of law as provided under the 1997 Constitution of Thailand and International Covenant on Civil and Political Rights. Yet, even the Constitutional Court cannot question the decree. Thailand has been turned into a Banana Republic overnight!
Thailand: Not Smiling on Rights, 18 July 2005
For the first time, the United Nations Human Rights Committee examined the Initial Report CCPR/C/THA/2004/1) of Thailand on the implementation of the International Covenant on Civil and Political Rights on 19-20 July 2005. Human rights situation in Thailand has been deteriorating day by day. The Emergency Decree of 15 July 2005, which gives absolute powers to the Prime Minister to declare emergency without the parliamentary approval, take measures to derogate from Articles 4, 9, 12, 17 and 19 of the ICCPR and also provide absolute impunity to the security forces, is a clear example.
